Hereafter Exclusive Cars (Nottm) Ltd shall be known as “The Company” and the person signing the confirmation shall be known as “The Hirer”. It will be deemed that The Hirer accepts responsibility by Himself / Herself for every person in his / her party and fully agrees to the conditions of hire as follows:
1. a) All bookings are pre-booking only and must be confirmed immediately with a deposit as specified before it is acceptable as a positive booking.
b) On short notice bookings payment must be made in advance either by cash prior to commencement of hire or by cheque at least 14 days before the date of hire, except where stated on special hire.
c) On weddings and special hires, e.g. Daily, Ascot, Silverstone etc. payment in full must be received by our office at least 21 days before date of hire. If payment is not received by this date, the booking will automatically be cancelled and your deposit forfeited.
2. a) In the event of cancellation, any deposit paid would be forfeited.
b) No refund will be given on full payments made by The Hirer if cancellation is made after the 21 day period stated above.
3. In the event of breakdown or accident to the vehicle booked prior to the date of the booking, every effort will be made to supply a similar or alternative vehicle/s at the Companies discretion.
4. No responsibility whatsoever can be accepted for adverse weather conditions, which may cause delay or cancellation of a booking by The Company.
5. Whilst every effort is afforded to the serviceability of the vehicles, no responsibility can be accepted for mechanical, electrical or material breakdown howsoever caused. In this unlikely event every effort will be made for immediate repair of the vehicle so that the journey can continue, or The Hirer would be transferred to another vehicle/s and any reasonable costs will be bourne by The Company or refund given. Note: In the event of conditions 4 and 5 or any other breakdown and / or accident no responsibility will be accepted for missed connections and / or functions, howsoever caused.
6. The Company reserves the right at any time to change / replace or renew the vehicle/s booked or advertised in order to maintain The Company’s high standard.
7. The Hirer (as assigned overleaf) shall be fully responsible and liable for any damage caused both inside and outside the vehicle/s by The Hirer or any members of his / her party, howsoever caused. This includes incitement to ANY Third Party, which results in damage to the vehicle or its contents. The Hirer will agree to be liable for the total retail cost of the repair, and the location of the damage repairer will be determined by The Company. In addition The Hirer will be liable to pay The Company a fixed daily rate (determined by the Company) while the vehicle is out of commission for such repair, plus any further incurred losses, i.e. by lost bookings. If any of the Hirers party is sick in the vehicle there will be a cleaning charge of £200.00. The Hirer is fully responsible for the payment of this.
8. The consumption of food / food products within the vehicle/s is not permitted.
9. The supply of alcoholic drinks by the Company may only be consumed within the vehicle and must not be removed from it at any time.
10. The Company or its representatives (e.g. chauffeur) reserve the right to refuse entry to the vehicle to any person / persons they deem unfit for whatever reason and can refuse to continue the journey if any person / persons behave in a manner which may be detrimental to other persons or to the vehicle and its contents. In this event no refund will be given.
11. Any extra requests or alterations to the booking (i.e. additional pick-up points, change of venue causing extra mileage and time) not made at any time of booking / confirmation cannot necessarily be entertained, although every effort will be made to meet the requirements of The Hirer. Any such alterations would in most cases involve extra charges being levied on the original quotation. Any extra charges incurred should be paid in cash to the chauffeur during the course of the hire.
12. Once a booking is made and confirmed and deposit paid, the price quoted to The Hirer will not be subject to alteration unless there is a deviation from details of the booking (see condition 11)
13. The “Company’s Discretion” shall be decided by the Owners of The Company at all times, and their decisions be fully binding in all matters.
14. No smoking in vehicles at any time
